Actions in Contract, Tort, and Property

Most people understand the concept of suing on a contract or law suits with respect to property.  What some people find confusing is an action in Tort.  A Tort is a wrong committed against you for which you can collect damages.  Someone intentionally removes your fence or damages your property and most often your cause of action (your law suit) will be filed as a Tort action.  Jensen and Associates stands ready to assist you in almost all actions regarding contracts, Tort, or property disputes.  We have worked for both defendants (those being sued) and Plaintiffs (those filing the suit).  Success in these actions always depends on the facts and the client’s ability to convey those facts to the Judge.  We make every attempt to take a very reasonable approach in all litigation explaining the costs to the client at every stage of the proceedings. Whether the action is an individual action or one resulting from a business relationship, we are ready to assist you in the litigation as effectively as is possible.

Collections

Collections is simply the process of collecting for you, money that is owed to you.  It has been said that the easiest part of the litigation process is getting the judgment; the hardest is collecting that judgment. We are ready to help either individuals or businesses collect the funds that are due to them.  We work with our clients at every step of the process to make sure that they understand the cost of going forward.  If there is not a contract or a law that allows the prevailing party to collect attorney fees from the losing party, we make sure to counsel the client on the risks at every stage in the proceeding.  Through the use of Proceeding Supplemental actions and Garnishment, we work diligently to collect the funds that are due you. 

Consumer Protection

Whether it is the solicitation over the phone, a door-to-door salesperson or something more sophisticated, Jensen & Associates is here to help you protect your rights as a consumer.  If we can get you help through an existing State or Local agency and save you legal fees, we will try and do so.  If not, we are prepared to use the law as effectively as possible to address any wrong that you have suffered.

Injunctions / Restraining Orders

Sometimes, in the course of legal proceedings, it is necessary to seek an Injunction or a Restraining Order to preclude someone from taking some action.  An injunction enjoins or stops someone from proceeding with an action such as moving equipment out of the state that is the subject of the dispute.  Using the same example, a restraining order is very much the same in that such an order would “restrain” or keep the person from moving the property out of state. A notice is required to the opposing side when one is seeking such an order, but under certain circumstances, you can ask the court to approve such an order without notice to the opposing party.  Protecting your assets, or the assets in dispute, can be a complicated task and Jensen & Associates stands ready to prosecute such actions.

Personal Injury

Auto accidents are almost a way of life.  Everyone reading this remembers when they have been stopped in traffic for either minutes or hours while emergency services attempt to help the people involved and clear the road ways.  The end result of most of those accidents is some kind of personal injury to one or more of those involved in the crash.  We are prepared to help you in every way possible to maximize the amount of your recovery in the event that you are injured on our Indiana roads.
